terms
These are the terms for bookable — a Shopify app for selling in-person experiences — and for this website, heybookable.com. bookable is built and operated by Public House LLC ("we", "us"). By installing the app or using this site, you agree to these terms.
who these terms apply to
bookable has two kinds of users, and the relationship is different for each:
- Merchants — Shopify store owners and staff who install bookable to sell experiences. These terms are an agreement between the merchant and us.
- End customers — people who book an experience from a merchant that uses bookable. Your booking is with the merchant, not with us. The merchant's own terms, refund policy, and waivers govern your booking. We provide the software the merchant uses to run it.
what bookable does
bookable lets a merchant publish offerings (classes, events, retreats, appointments), generate sessions on a schedule, sell tickets through Shopify checkout, collect waivers and ID verification when the merchant requires them, and check attendees in on the day of the experience. Payment is processed by Shopify. bookable never sees a card number.
your account
Access to bookable runs through your Shopify staff account. You're responsible for keeping your Shopify credentials secure and for the actions of every staff member you give access to. If you think your account has been compromised, contact us and disable the affected Shopify staff account immediately.
what you can do with bookable
We grant you a non-exclusive, non-transferable right to use bookable inside your Shopify store while these terms are in effect. You may not:
- Resell, sublicense, or white-label the app
- Reverse-engineer, decompile, or copy the app's code or design
- Use the app to send spam, run scams, or facilitate illegal activity
- Use the app to sell experiences you don't have the right to sell, or that violate Shopify's Acceptable Use Policy
- Probe, scan, or attempt to disrupt the service or its underlying infrastructure
your responsibilities as a merchant
- Your offerings. Descriptions, pricing, schedules, cancellation policy, and refund policy are yours. Make sure they're accurate and that you can deliver what you sell.
- Your customers' data. You're the controller of booking and attendee data inside your installation — see the privacy policy for the split. You're responsible for handling customer requests, deletions, and disputes in line with applicable law.
- Your documents. Waivers, contracts, and terms you upload to bookable are your documents. You're responsible for their legal sufficiency in your jurisdiction. bookable records the typed signature, IP, user-agent, timestamp, and exact text agreed to — but we don't review or vouch for the content.
- ID verification. If you require ID verification, you must comply with applicable identity-verification and data-protection laws and with Stripe Identity's terms.
- Refunds and disputes. Because payment runs through Shopify, refunds and chargebacks are between you and your customer. We can't issue refunds on a merchant's behalf.
fees
bookable's pricing — if any — is shown in the Shopify App Store listing and inside the app at install. Shopify bills app fees on our behalf through your Shopify account. You're responsible for any fees Shopify, Stripe, or other payment processors charge on your transactions.
third-party services
bookable depends on Shopify, Stripe (for ID verification), SendGrid (for email), Neon (database hosting), and Railway (application hosting). Your use of bookable is also subject to those providers' terms. We're not responsible for outages, errors, or policy changes at those providers, though we'll work to mitigate the impact when something goes wrong.
intellectual property
bookable, the heybookable.com website, the Public House name and marks, and all software, design, and copy we produce are owned by Public House LLC. You keep ownership of the content you upload — offerings, images, documents, host bios — and grant us a limited license to host, display, and process that content as needed to run the service for you.
privacy
How we handle data is described in our privacy policy. By using bookable, you agree to the practices described there.
service availability
We aim to keep bookable up and working, but we don't guarantee uninterrupted service. We may release updates, change features, and do maintenance. We'll give reasonable notice before retiring a feature merchants depend on, when we can.
disclaimers
bookable is provided "as is" and "as available". To the fullest extent allowed by law, we disclaim all warranties — express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the service will be error-free, secure, or uninterrupted, or that the data it produces will always be accurate.
limitation of liability
To the fullest extent allowed by law, Public House LLC's total liability arising out of or related to bookable will not exceed the greater of (a) the fees you paid us for the service in the twelve months before the event giving rise to the claim, or (b) one hundred US dollars. We're not liable for indirect, incidental, special, or consequential damages — including lost revenue, lost bookings, or lost data — even if we've been advised of the possibility.
indemnification
As a merchant, you agree to defend and indemnify Public House LLC against claims, losses, and expenses arising from your offerings, the content you upload, your handling of customer data, your compliance with applicable law, or your breach of these terms.
termination
You can stop using bookable any time by uninstalling the app from your Shopify store. We can suspend or terminate access if you breach these terms, if required by law, or if continuing to provide the service would expose us or other users to material risk. On termination, the data-deletion timeline in our privacy policy applies.
governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in California, and you consent to that jurisdiction.
changes
We may update these terms. If we make a material change, we'll update the date at the top of this page and, where required, give direct notice. Continued use after a change means you accept the updated terms.
